The parties to the work are the brand/agency and creator identified in the agreement summary, including their representative details. Platform operator Mobicraft Dijital Teknolojiler Limited Şirketi is responsible for its platform service and does not become the content-service provider unless expressly agreed. These terms are read with the frozen proposal, cash/product/commission schedule, party details and applicable country additions. The accepted revision, digest and electronic event records identify the agreed document; later profile or template changes do not replace it.
The commercial schedule identifies content type/quantity, description/brief, media, target markets, delivery/publication dates, IANA time zone and agreed revisions. Neither party promises assumed sales, views or engagement. The brand supplies necessary products, brief, claim substantiation and materials; the creator performs with appropriate skill and care. Ambiguous scope, extra work or timetable changes must be clarified by recorded agreement. An unapproved change must not be treated as granting a new fee or right.
The fixed cash fee and currency are the actual amount in the commercial schedule. Product/experience value is not a cash service fee; a non-cash assignment does not create fixed-fee collection. Product identity, quantity, value, ownership after completion, shipping/customs costs and any return conditions must be specified separately. Affiliate rate, eligible product/sale scope, attribution period and refund/cancellation/maturity rules are recorded in their schedule. Commission depends on qualified transactions, with no minimum earnings guarantee. No tracking of every external sale is promised without the supported active store/product and country conditions. Taxes, deductions, platform charges and official documents depend on transaction and country status; universal 20% VAT or a single withholding rate is not assumed.
The creator submits the content and required publication evidence against the work record. The brand reviews against the agreed brief and records acceptance or a reasoned revision request using the available review/dispute process. Silence is not automatically legal acceptance in every case. For shipped products, the creator supplies correct delivery details, the brand records dispatch and the creator confirms receipt. Actual events and evidence govern; a button or status change cannot represent a delivery that did not occur. Closing a non-cash assignment does not promise fixed-fee payment.
Pre-existing works, marks and materials remain with their owners. Ownership or all economic rights in new content do not transfer automatically merely upon payment, delivery or approval. Permissions must separately identify reproduction, distribution, performance, communication to the public and adaptation where relevant, together with duration, territory, media, organic/paid advertising use, editing, reuse, sublicensing and third-party use. Without specific permission there is no whitelisting, account access, AI training, face/voice cloning or unrestricted advertising right. Required written form, qualified signature and third-party permissions must be completed separately. Moral rights and mandatory copyright law are preserved. Clarify missing or ambiguous rights in writing before commencing broader use.
Payments, gifts, discounts and sales commission must be disclosed in language the audience understands, prominently and alongside the content. Applicable local advertising rules, the media platform’s tools and sector restrictions must be considered together. Brands substantiate claims; creators preserve truthful experience and disclosure. Undisclosed advertising, fake reviews/engagement, misleading comparisons and unsupported health, financial or success claims are prohibited. Advertising involving children, health, finance, alcohol or other sensitive sectors requires the applicable additional restrictions to be checked.
The parties use confidential information and personal data shared for the assignment only for necessary purposes, with appropriate access and security. Sharing is limited with regard to the recipient, data category and legal basis. Do not use unauthorised faces, names, messages, third-party images or music. Each party retains its own processing responsibilities; separate processing or transfer agreements must be established where needed. This collaboration agreement does not by itself make every international data transfer lawful. Necessary disclosures for legal duties or protecting rights are assessed separately from confidentiality restrictions.
Material breach, delay, impossibility or mutual termination is handled through the available cancellation/dispute process. Completed work, retained/returned products, accrued qualified commission and payments are assessed against the records; automatic full refunds or unagreed penalties are not invented. Closure/cancellation of affiliate work may stop new activity through its links; earlier transactions remain subject to existing refund, cancellation and maturity conditions. Force majeure affecting an obligation or timetable must be notified promptly. Support can assist with resolution; legal remedies and mandatory local protections remain available.
The platform records an authenticated account’s acceptance of an identified document. A drawn signature, checkbox or button does not automatically constitute a secure electronic signature under Turkish Law 5070 or a qualified electronic signature under eIDAS. Handwritten-signature equivalence or conclusive evidence is not guaranteed worldwide. Where law requires a special form, the required method must be satisfied separately. Residence, incorporation/tax countries and target advertising markets are assessed separately. Turkish law is a base, subject to mandatory country rules and relevant target-market additions. Courts and authorities are determined with regard to mandatory jurisdiction rules.
This revision does not provide a separately reviewed national-law addition for this country. General terms do not override mandatory local consumer, advertising, privacy, copyright, tax or formal requirements governing the actual transaction. Language or country selection does not establish country-specific legal clearance, payment availability or universal contractual validity. Any necessary additional conditions must be clarified for the parties and applicable law.
