Define deliverables, channels, duration, paid advertising and revisions before producing UGC.
Producing a video for a brand and authorising its use in advertising are separate decisions. A useful agreement describes exactly what is delivered and how the brand may use it. The official French guide describes creator rights and duties; specific clauses must fit each project.
Describe the delivery
State format, indicative duration, deadline, versions and number of revision cycles. Distinguish correcting an error from a new creative request. If the brand wants raw files, specify that delivery and its price before filming.
Define distribution
List channels, territories, licence duration and organic or paid uses. Separate publication from the brand's account from advertising using the creator's account. Address adaptations, subtitles, transfers to partners and expiry. Music, filmed people and third-party elements may require separate rights. Have clauses reviewed for the circumstances: a checklist is not a substitute for a suitable contract.
Example scope for negotiation
A creator delivers a 30-second vertical video and a subtitled version. The brand wants to publish them for six months on its own accounts in France. A month later it wants to use the video in paid advertising. Before that new use, the parties review their agreement and negotiate any additional duration, channels and payment. The example describes negotiation, not a universal legal template.
Copyright and image rights depend on the elements in the film; one participant's permission does not automatically cover others. The French public service guide to copyright explains principles for creations and contracts. Have suitable counsel confirm the precise scope.
Checklist
- Describe files, versions, schedule and included corrections.
- List media, territory and term, separating organic and paid use.
- Clarify who approves adaptations and whether raw files are included.
- Check music, voices, people, locations and other third-party elements.
- Plan payment, extensions and removal when permission expires.
Frequently asked questions
Does delivery of the file authorise every use? Do not assume so; inspect the agreed rights and necessary permissions.
Can the campaign be extended? Discuss the extension before expiry and record the new terms.
