A practical guide to UGC briefs: agree channels, duration, editing and paid advertising before production begins.
A finished video and permission to use it however one wishes are not the same. If a brand wants creator material on its product page and later wants to test it as an ad, it should describe these uses clearly before booking. This protects the production plan and avoids renegotiation under time pressure.
First the assignment, then the rights
Describe the deliverable specifically: for example, one vertical video, a product demonstration, two agreed edits and one correction round. State who supplies the product, which claims can be substantiated and when feedback will be given. Example material is guidance; creators should not reproduce other people's content without checking it.
Then make a separate rights overview. German Copyright Act section 31 provides that usage rights can be limited by territory, time and content, among other things. Which rights are needed and validly agreed in a specific project depends on its circumstances.
| Question | Example of a clear definition |
|---|---|
| Where? | Organic brand channel and product page; name the specific channels. |
| For how long? | An agreed period from approval; record start and end. |
| Paid advertising? | State separately, including platform, term and any account use. |
| Editing? | Describe cuts, captions and format changes separately. |
| Sharing? | Specify the agency or provider and purpose of sharing. |
“All rights worldwide forever” is not a useful substitute for an undefined project. Instead ask which use is actually planned. If a brand later wants to use the video in a new market, it can request a suitable extension.
Check music, people and raw material
A creator cannot automatically transfer rights to every song, logo or person filmed. Agree in advance which materials are permitted for the intended use and who obtains necessary permissions. Raw files are a separate deliverable: agree their scope, secure transfer, retention period and fee explicitly.
Advertising identification depends on the format and facts. For creator-channel publications, the Medienanstalten guide offers practical classification. A rights overview does not replace this check.
A simple approval process
- Confirm the brief and usage scope together.
- Review the draft with one responsible contact.
- Send consolidated change requests within the agreed time.
- Store the approved version, rights scope and end date together.
- Recheck the agreement before a new use.
Does paying for the video cover paid advertising?
Payment alone should not be taken as unlimited advertising permission. Agree the intended use explicitly.
Must every UGC project include raw files?
No. Whether raw material is delivered is a separate matter of scope, price and rights.
