Review collaborations, gifts and advertising notices in videos aimed at audiences in Spain.
A collaboration may include money, products or other benefits. Before publishing, clarify what each party receives and how the commercial relationship will be shown. Your audience must be able to distinguish editorial recommendations from promotional content.
CNMC's 2026 guidance says advertising must be clearly identified and the notice must be visible within the video. Read the full guide and check the rules for your format, platform and circumstances.
Review the relationship before creating
Ask whether there is a brand instruction, payment, free shipment or link commission. Keep the brief and scope discussion. A brand tag alone does not explain the relationship; prepare a clear, visible notice for someone watching without opening the description.
Treatment of a gift depends on its circumstances. Do not assume a free product is the same as a personal purchase, or that every independent brand mention is advertising. Examine the consideration, agreement and commercial purpose against current sources.
Check each format
- Put the notice inside the video and check it is readable on mobile.
- Review the description and platform tools without assuming a technical setting replaces every requirement.
- Check each promotional story or segment separately: someone joining midway needs context too.
- For an affiliate link, explain the relationship and possible benefit clearly.
- Keep a copy of the published version and approval.
Law 13/2022 provides specific duties for users of particular relevance when legal conditions are met. That regime should not be mistaken for general permission to hide advertising below a particular follower count.
Discuss an ambiguous brief with the brand
Ask which claims are substantiated, what will be published and who approves changes. Do not describe an experience you have not had. If an organic video becomes a paid ad, revisit both disclosure and usage rights.
Frequently asked questions
Is a notice at the end of the caption enough? In the audiovisual cases described by CNMC, identification must be visible inside the video; do not rely only on the caption.
Is a gift assessed like a personal purchase? Not necessarily. Review the source of the benefit, relationship with the brand and purpose of the content.
